Spin & Win Terms and Conditions

TERMS AND CONDITIONS FOR THE "EAGLE BOYS PIZZA - SPIN & WIN PROMOTION" (PROMOTION)
 
1.    These terms and conditions, including information on how to participate and gift details (Terms), apply to this Promotion and participation in the Promotion is deemed acceptance of these Terms.
 
2.    The Promoter is EAGLE BOYS DIAL-A-PIZZA AUSTRALIA PTY. LIMITED trading as EAGLE BOYS PIZZA (Administrators Appointed), ABN: 25 003 169 391, of 493 Ipswich Road, Annerley, QLD 4103 (Promoter).
 
3.    Claimants are responsible for ensuring their familiarity with these Terms. The Promoter’s decision not to enforce a specific restriction (whether communicated to a claimant or not) does not constitute a waiver of that restriction or of the Terms generally.
 
4.    All claimants acknowledge that the Promoter can rely on these Terms even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a gift to the ineligible person. Payment of the gift’s equivalent value to the Promoter may be required by the Promoter if this occurs.
 
5.    The Promoter’s decision in relation to any aspect of these Terms and the Promotion is final and binding on every person who participates. No correspondence will be entered into.
 
PROMOTION PERIOD
 
6.    The Promotion will commence at 00.01 AEST on 28/11/2016 and conclude at 23:59 AEST on 22/01/2017 (Promotion Period).
 
WHO CAN PARTICIPATE
 
7.    Participation in the Promotion is only open to Australian residents aged 16 years and over, who have their parent/guardian’s permission to participate if under 18 years of age, excluding:
 
(a)  management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the gifts);
 
(b)  a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 7(a) of these Terms;
 
(c)  persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
 
(Eligible Claimant). The persons referred to in paragraph 7(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Claimant in its absolute discretion.
 
HOW TO PARTICIPATE/CLAIM A GIFT
 
8.    To participate and be eligible to claim a Gift (as defined in paragraph 11), Eligible Claimants must, during the Promotion Period, order any one (1) or more pizza (“Garlic Pizza Bread”, and “Kids Pizzas” excluded) and any one (1) or more Eligible Drink (as defined in paragraph 9) in one (1) transaction online at www.eagleboys.com.au or via the Eagle Boys Pizza app, for pick-up, delivery or “Virtual Drivethru” from an Eagle Boys store in Queensland only (Qualifying Order).
 
For the avoidance of doubt, pizza/s and Eligible Drink/s included as part of any “meal deals” are eligible as part of a Qualifying Order.

9.    Eligible Drinks are 375ml cans and 600ml, 1.25L and 2L bottles of Coke, Coke Zero, Diet Coke, Coke Ginger, Fanta, Sprite and Lift Hard Hitting Lemon; 600ml and 1.25L bottles of Coke Life; 600ml bottles of Mount Franklin Still and 350ml bottles of Goulburn Valley Orange Juice (Eligible Drinks). Please note that some Eligible Drinks may not be available in all stores.
 
10. Upon checking out a Qualifying Order, subject to the Claim Limit in paragraph 13, the Eligible Claimant will be prompted to spin the online wheel to reveal which Gift they will be awarded (Eligible Claim).
 
The Eligible Claimant may elect not to spin the online wheel and not reveal/receive a Gift.
 
The Eligible Claimant may also elect not to claim/receive the Gift revealed upon spinning the online wheel.
 
If an Eligible Claimant has made a Qualifying Order but does not spin the online wheel to complete their Eligible Claim, no Gift will be awarded.
 
11. Each gift is one (1) item randomly allocated from the options below:
 
(a)  One (1) x 1.25L Coke, valued at $4.95 RRP (including GST);
(b)  One (1) x 1.25L Diet Coke, valued at $4.95 RRP (including GST);
(c)  One (1) x 1.25L Coke Zero, valued at $4.95 RRP (including GST);
(d)  One (1) x 1.25L Lift Hard Hitting Lemon, valued at $4.95 RRP (including GST);
(e)  One (1) x 1.25L Sprite, valued at $4.95 RRP (including GST);
(f)    One (1) x 1.25L Fanta, valued at $4.95 RRP (including GST);
(g)  One (1) x Choc Caramel Dessert Thingie, valued at $4.95 RRP (including GST);
(h)  One (1) x Apple Crumble Dessert Thingie, valued at $4.95 RRP (including GST);
(i)    One (1) x Tropicana Dessert Thingie, valued at $4.95 RRP (including GST);
(j)    One (1) x Triple Choc Dessert Thingie, valued at $4.95 RRP (including GST); or
(k)   One (1) x Garlic Bread, valued at $3.95 RRP (including GST),
 
(Gift).
 
12. Upon opting to receive the awarded Gift, it will be automatically added to the Eligible Claimant’s Qualifying Order. The Gift must be taken with the Qualifying Order and cannot be redeemed later.
 
13. There is a limit of one (1) Gift per Qualifying Order and a limit of one (1) Gift per Eligible Claimant per day (Claim Limit).
 
14. Gifts are not transferrable, exchangeable or redeemable for cash. Gifts must be taken as offered and may not be varied.
 
15. Any costs associated with accessing the online order form are the claimant’s responsibility and are dependent on the internet service provider used. Eligible Claimants must submit their Qualifying Order manually using an internet browser.
 
16. Incomplete or otherwise illegible orders will not be eligible to receive a Gift.
 
17. Orders are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the claimant. The Promoter accepts no responsibility for any claims not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected claims.
 
18. To the maximum extent permitted by the law, the Promoter shall not be liable for a Gift being lost, stolen, damaged or tampered with in any way before it reaches or after it is released to the Eligible Claimant.
 
19. The Promoter accepts no responsibility for any variation in the value of the Gifts from the time of printing Promotion materials.
 
20. If the Promoter is unable to provide a claimant with the nominated Gift, the Promoter reserves the right to supply an alternative gift of similar monetary value to the nominated Gift, subject to any directions given by state and/or territory gaming departments.
 
21. The Promoter does not warrant that the online ordering/claim mechanism will be available at all times during the Promotion Period.
 
22. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to state and/or territory regulations, including cancelling, terminating, modifying or suspending the Promotion.
 
23. Any claimant who, in the opinion of the Promoter, tampers or interferes with the claim mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the claim process, will be ineligible to claim a Gift.
 
24. The Promoter reserves the right to disqualify claims, at any time, in the event of non-compliance with these Terms.
 
25. If requested by the Promoter, Eligible Claimants must produce, within the time requested by the Promoter at its absolute discretion, appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a Gift, and compliance with these Terms. If the items required by the Promoter are not received or a claimant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the claim/s submitted by the claimant will be deemed invalid. A Gift will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
 
26. Claimants can only participate in the Promotion in their own name. Claimants who use multiple aliases (e.g. multiple names, addresses and/or email addresses) will be disqualified and will not be eligible to claim a Gift.
 
27. The:
 
(a)  Promoter, the Promoter's related entities and all agencies associated with the Promotion; and
 
(b)  the employees, agents, directors and contractors, of all entities referred to in paragraph 27(a),
 
shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or acceptance of a Gift, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
 
28. Claimants may be requested by the Promoter to participate in any Promotion activity (such as publicity and photography) relating to the claiming of the Gift, and the Claimant consents to the Promoter using free of charge his/her name and image in any future promotional material.
 
29. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.
 
PERSONAL INFORMATION
 
30. Immediately upon submission by a claimant, their claim/s become the sole property of the Promoter.
 
31. All information claimants provide (Personal Information) will be used by the Promoter for the purpose of administering this Promotion and fulfilling Eligible Claims.
 
32. The Promoter may disclose claimants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.
 
OPTING-IN TO HEAR FROM THE PROMOTER
 
33. Should a claimant consent to receiving future information from the Promoter, via placing a tick in the ‘opt-in’ box featured on the online order form, information provided by the claimant may be entered into a database and used by the Promoter, the Promoter's related entities and agencies engaged by the Promoter for the Promoter's current and future promotional and marketing purposes without further reference or compensation to them.
 
34.  Claimants may request access to update or correct their Personal Information held by the Promoter and may request that they not receive further promotional or marketing communications from the Promoter at any time by contacting the Promoter using the Contact Us form available at https://www.eagleboys.com.au/Corporate/Contact-Us

35. Claimants may view the Promoter’s privacy policy by visiting https://www.eagleboys.com.au/Corporate/Privacy-Policy  The privacy policy details how a privacy complaint can be made.
 
36. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (The Privacy Amendment (Enhancing Privacy Protection) Act 2012).
